Who this page is for

TL;DR

Property transactions are among the largest financial decisions of your life. J&J Associates ensures your title is clear, your agreement protects you, and any disputes are resolved firmly, whether you are buying, selling, or defending a property claim.

Pune's real estate market has grown rapidly, and with that growth comes complexity. Title disputes, encumbrances, RERA non-compliance by builders, and fraudulent transactions are all too common. We have spent over two decades protecting clients' property rights in Pune.

Our property legal services cover the entire lifecycle of a real estate transaction, from title due diligence and agreement drafting to registration, possession, and dispute resolution. We regularly handle NRI property matters involving properties managed or disputed by family members in India.

We also represent buyers and home-owners before the Maharashtra Real Estate Regulatory Authority (MahaRERA), seeking possession, refunds, or compensation from builders who have violated RERA provisions.

Mistakes we see every month

Skipping title due diligence

The Harm: Buying property without a proper title search can mean purchasing a property with encumbrances, disputed ownership, or illegal construction, leaving you with no legal remedy.

How we prevent it: We mandate title due diligence before any purchase. It is the most important ₹ you will spend in a property transaction.

Not registering the agreement to sale

The Harm: An unregistered agreement has very limited legal enforceability. Many buyers make payments on an unregistered document and have no recourse if the seller disputes it.

How we prevent it: All agreements involving payment of more than 10% of consideration must be registered. We ensure registration at the correct stage.

Relying on builder's lawyer

The Harm: The builder's lawyer works for the builder, not for you. Their agreement will favour the builder in every clause.

How we prevent it: Have your own lawyer review or draft the agreement. We review builder agreements and negotiate better terms for buyers regularly.

06

Fees, discussed upfront

Property fees are structured as: (1) due diligence fees, (2) agreement drafting/review fees, (3) registration assistance fees, and (4) dispute/RERA matter fees, each billed separately.

Government stamp duty and registration charges are in addition to professional fees and are paid to the government. We provide exact duty calculations based on the transaction value.

Frequently Asked Questions

A title search is a review of all historical property records to confirm that the seller has clear, unencumbered ownership and the legal right to sell. Without it, you may be buying disputed property or property with bank mortgages against it.

File a complaint before MahaRERA. You can claim possession with penalty (at the rate specified in your agreement), or claim a full refund with interest at 10.75% per annum under RERA. We have handled numerous such matters.

Yes. NRIs can purchase residential and commercial property in India (not agricultural land). The transaction typically requires a properly executed Power of Attorney if you are not in India to sign documents personally.

Stamp duty in Maharashtra varies by property type and location, typically 6% for men and 5% for women buyers within municipal limits, with a 1% registration charge additional. We provide the exact calculation for your transaction.

You can file a suit for possession and permanent injunction before the Civil Court. Where urgency exists, we apply for an immediate interim injunction. In cases of illegal construction, we also file complaints with the municipal authority for demolition.
